Item pirate with a Mercenary

Hi!
I've won this match but nevertheless I'm curious about this.
The opponent started to play with that golem adding 2 Pirate items, although he's a mercenary.
How did he do that?
Am I not seeing anything obvious? If so, please someone enlight me.

the giant is golem, and golems can use any item without restrictions
